What is mediation you ask? Briefly, mediation is a process in which parties in a conflict engage the services of a neutral third party to assist them in reaching a resolution of the issues that are in dispute.
Conflict
Conflict could be a serious disagreement or argument between people, organizations, or parties in a court proceeding etc. It could be an incompatibility or clashing between co-workers, supervisors, or family members. Conflict exists in our day to day lives and we are constantly negotiating ways to manage it. Sometimes, it can help to engage the services of a mediator.
The Mediator
The mediator does not make decisions or provide legal advice. The mediator assists the parties to communicate with each other and negotiate an acceptable settlement.
There are many hidden reasons conflict exists and the mediator is trained to discover these hidden reasons. Once these hidden reasons are discovered, discussed, and explored, often the parties can move forward and brainstorm ways to resolve the core issues of the conflict.
When Is Mediation A Good Idea?
Mediation is a great tool to avoid costly litigation, preserve a working relationship between co-workers, or family members, and is time efficient. Mediation fosters cooperation, collaboration, improves communication, and rebuilds trust between the parties. The agreements that are reached as a result of a mediation are often honoured for longer periods of time because the parties fashioned these agreements with creativity that is tailored to meet their needs.
Is Mediation Ever A Bad Idea?
Mediation is not the best choice if someone’s safety is at risk or where there has been domestic violence or child abuse.
Mediation is not a good idea when parties are not attending with a “good faith” intent to work together to resolve the dispute. This could result in wasted time money.
When Is The Best Time for Mediation?
Anytime. When used early, mediation can solve conflict without prolonging the harmful effect of the conflict on the parties, their environment, or those around them. Mediation can also be used as a last resort to avoid further litigation costs.
